INTRODUCTION In 1997, in response to its nation's HIV epidemic, the South African Parliament proposed the Medicines and Related Substances Control Amendment Act. The Act empowered the Minister of Health to allow compulsory licensing and parallel importing in certain situations, in order to create "conditions for the supply of more affordable medicines ... so as to protect the health of the public." (1) The subsequent dispute between South Africa and the United States brought to public attention international disputes over pharmaceutical patents in developing countries.
